Scofflaws cited for cycling on sidewalk

So Leslie and Duane Smith and Matt and Sharon Pierce hopped on their bikes, left their picturesque enclave in Newport Beach’s Bayshores Community, and ventured out into the “real world.”

The Pierces, who were at the front of the convoy, commented on how crazy things seemed. The officer said he wouldn’t ride in this area at all; it’s dangerous, and many accidents are reported; the Pierces smiled, thinking the officer was stressing how careful they should be riding their bikes.

They were quite surprised when that officer soon pulled them over for riding on the sidewalk.

“Did he really need to use his sirens and lights for stopping 4 emerging senior citizens leisurely riding their bikes?” Leslie Smith asks us in an exhaustive email account detailing the incident. “We were treated like common criminals and issued traffic tickets, going so far as to fingerprint me as I had inadvertently left home without my drivers license. The police officer claimed that, according to CA Code 12.56.030 (A) NBMC, it is against the law to ride a bicycle on a sidewalk in CA, despite the ever present signs posted on the sidewalk along PCH that state ‘Bike Route – Bike Riding Permitted on This Sidewalk.’"

What a bad civics lesson for our children. In school, California's students learn that, under the U.S. Constitution, America has a federal system of government. The federal government performs certain functions, such as national defense, while most things "are reserved to the states respectively, or to the people," as the 10th Amendment mandates.

Education, obviously, is a state and local issue. But on Aug. 2, the California Board of Education knuckled under to federal pressure to ease California school standards. This was done when the board voted to implement the school standards for President Barack Obama's Race to the Top initiative. The new standards replace much more vigorous California standards. The unanimous vote of the 10-member board means that California now can qualify for a chunk of the $700 million in federal grants to state schools under the Race to the Top program. The board's vote promotes "California's high expectations and our belief that every student is capable of success in the classroom," Gov. Arnold Schwarzenegger said.

Judges twice last week found ballot language prepared by Attorney General Jerry Brown to be misleading and ordered the wording stricken from sample ballots for the November election.

We applaud both court decisions. Voters now will receive more accurate summaries of two crucial November ballot initiatives – Proposition 25, which would reduce from two-thirds to a simple majority legislators' standard for passing a state budget, and Prop. 23, which would delay implementation of California's most Draconian global warming law.

But we are troubled by what appears to be the state's top lawman attempting to mislead voters in a way that also appears to favor his political agenda. This is all the more troubling considering Mr. Brown wants to be the next governor. The "stimulus" boosted federal spending, thus draining funds from private-capital markets and diverting resources from the productive sector of the economy. The main jobs that it "saved" were employees of state and local governments — shielding the public sector from pain even as it inflicted more agony on the private sector.

The health-care law is a cornucopia of new taxes, mandates and regulations — directly increasing the cost of hiring new employees (as well as of keeping old ones on). By telling employers that the cost of hiring is set to rise sharply in the years ahead, it makes them far more cautious about hiring.

The new bailout legislation, though labeled "financial reform," raises costs for financial firms, meaning loans will be more expensive. That is, investing in that truck or computer for that new hire will cost you more.

82-year-old Robert Wallace said he fired two shots at two men when they tried to run him over while stealing his flatbed trailer.

Wallace now faces twelve felony counts, including four counts of attempted first degree murder, for what he described as an act of defending his property and his life. If convicted, he could spend the rest of his life in prison.

One of the thieves, Damacio Torres later admitted to the theft. He and his partner in crime, Alvara Cardano both have prior arrest records and are believed to be in the country illegally.

But they are not facing any charges.

Below are three bills that passed the State Assembly (over my objections in committee and on the floor). These bills are now awaiting action in the State Senate. While the Senate is on a break, find your State Senator and tell them to vote for freedom and against these three bills.

AB1934 seeks to punish citizens for engaging in the legal act of openly carrying an unloaded handgun. If California had a reasonable concealed carry law that was consistent and fair there would be no need for citizens to carry a gun in open.

AB2223 seeks to outlaw the use of lead shot when shooting or hunting in state-run wildlife management areas. Anti-hunting groups want to make it harder to hunt and this bill would do it.

AB1810 seeks to establish a Canadian style registration system, similar to the one currently in place for handguns, for all newly-acquired long guns. Under AB1810 require the Attorney General to keep the make, model and serial number of the firearm as well as the identifying information of the purchaser on file. If only the British had such a list!

The pretrial services system was designed for indigent arrestees who could not afford bail. Pretrial release is also sometimes called "detention release" or some refer to it as "released on (the defendant's) recognizance (ROR)." Usually, the three benchmarks for such release are:

•The defendant is not considered a danger to the community.

•The defendant is not a flight risk.

•The defendant is indigent and cannot afford bail.

Unfortunately, like so many government programs, pretrial release has ballooned into an overwhelming bureaucratic system that allows tens of thousands of arrestees a "get out of jail free" card without having to pay any bail, no matter what their financial resources may be. The pretrial services program employs thousands of public employee workers and serves to puts private bail bonds companies out of business.


One more reason you can add to the 1,000+ reasons California is going broke!

Government strikes again! From the Wall Street Journal:

Wall Street Journal, 6/23/2010 -- It looks as if Congress is about to permanently increase FDIC deposit insurance to $250,000 from $100,000 per bank account. What's more, it plans to make this increase retroactive to Jan. 1, 2008, in order to protect certain depositors at Indy Mac and other banks that became insolvent before the financial crisis reached its height. This move will substantially raise the cost of resolving troubled banks, and isn't necessary to protect small depositors.

The old limit of $100,000 per bank account was interpreted so flexibly by the FDIC that a family of four could easily obtain federal insurance for $600,000 by opening multiple accounts under different names. For example, a husband and wife could both deposit $100,000 in their personal accounts and their business accounts. These parents could also deposit $100,000 in savings accounts for both of their children.

Less than 2% of all bank accounts were above the old $100,000 limit. These uninsured accounts were not held by small depositors, but by high net worth individuals and local business people, many of whom could not easily create enough different accounts in one bank to cover their large deposits. Such accounts had an average balance of $432,000 as of June 2008.

By raising the maximum insurable amount to $250,000 per account, we will lose the market discipline exerted by these wealthy individuals and experienced business people. If they can split a $432,00 bank account into two accounts of $216,000, each under a different name, they would be fully protected under the new legislation. With a 100% guarantee from the federal government, why would they care whether the bank made imprudent loans or bought risky bonds?

Historically, the weakest banks have attracted a flood of deposits by advertising sky-high interest rates. These bankers typically believe that they can grow their way out of problems by investing in new loans and high-yield bonds. This practice was one of the key factors that caused the savings and loan debacle of the 1980s.

By raising the maximum insurable limit to $250,000 per account, we will enhance the ability of weak banks to expand their deposit base very quickly. The result is predictable: much higher costs for the FDIC when it takes over insolvent banks. Meanwhile, the FDIC is already struggling to handle the growing number of bank failures. It recently received a $500 billion line of credit from the U.S. Treasury.

When Congress raised the limit on insured deposits in October 2008 to $250,000 from $100,000 as a response to the financial crisis, it was supposed to expire at the end of 2009. Then, in the middle of 2009, without any hearings or much debate, Congress extended the temporary $250,000 limit until 2013. Now Congress is about to carve this limit into stone.

Congress is also giving serious consideration to making permanent an FDIC program for insuring unlimited amounts on corporate checking accounts in banks. This is another FDIC program that was supposed to be a temporary response to the financial crisis. If Congress extends unlimited insurance on corporate checking accounts, it will undermine the market discipline exerted by corporate treasurers and sharply raise the FDIC's cost of bailing out banks.

What's the rush? Community bankers believe they are at a competitive disadvantage to large banks that benefit from the public perception of being "too big to fail." These bankers have been pushing for higher limits on FDIC insurance since they rely heavily on retail deposits.

Although understandable from a political perspective, these permanent extensions of temporary FDIC insurance programs are bad policy. If political pressures require a permanent expansion of FDIC insurance of bank deposits, Congress should move to a two-tiered structure. The FDIC should fully guarantee the first $100,000 in any bank account, and should guarantee a lesser percentage (e.g., 80%- 90%) of any amount in that bank account between $100,000 and $250,000. That compromise would help community banks, retain a measure of market discipline, and reduce the FDIC's costs in resolving bank failures.

Wall Street Journal, 6/17/2010 -- Does Frankenstein's monster always have to be a monster?

Mortgage firms Fannie Mae and Freddie Mac grew into terrifying creatures because they are private companies with a government backstop. That has already cost taxpayers over $100 billion. Wednesday's announcement that their bombed-out shares are being delisted from the New York Stock Exchange is a reminder of how badly the public-private model worked. Unfortunately, most housing-finance overhaul plans floated assume this hybrid approach will continue.

Most reformers want entities that continue most of what Fannie and Freddie do-- buy mortgages from banks and package them into bonds to sell in the market. The key change reformers advocate is removing government backing for the entities. They want a government guarantee on the bonds issued by these entities.

Granted, that approach substantially limits the degree to which the Frannie-replacements benefit from the government intervention. But the danger is that the government, in its desire to support housing, underprices the guarantee, leaving taxpayers again exposed to potential losses.

People want government intervention in the belief the mortgage market needs support during economic slowdowns. But promising that support likely will hinder changes that could make the mortgage market more resilient. If the government withdrew, banks would design mortgages they would want to hold through an economic cycle. Right now, they would rather sell their new mortgages to Fannie and Freddie.

A more radical shake-up is needed to avoid another housing horror story.

The Orange County native has been active in conservative causes and campaigns since he was a teenager and, quite often as an adult, leading them. After stints in the Pentagon under Ronald Reagan and later on the staff of former Rep. Christopher Cox (R.-Calif.), he spent several years working for a defense contractor in Orange County.

Two years ago, DeVore, a frequent contributor to HUMAN EVENTS, was seeking a conservative candidate and became the first California Republican office-holder to back Fred Thompson for President. Now in his third term as a state legislator, DeVore defied liberal Republican Gov. Arnold Schwarzenegger’s call for a record-high tax increase in ’09 and later campaigned vigorously against the tax hike when it was on the statewide ballot. (The proposal lost resoundingly, forcing Schwarzenegger and the Democratic leadership in the state legislature to make spending cuts to balance the budget.)

In the first class the teacher asserted that right-wing conservatives supported Hitler and brought him and the Nazis to power. I asked who exactly was she referring to, since ‘Nazi’ is an acronym for the German National Socialist Workers Party, a decidedly left-wing group.

She refused to answer the question, so I asked for her definition of right-wing conservative. No reply.

DeVore sounds good – and believable devore, government, health - Opinion - The Orange County Register

Assemblyman Chuck DeVore of Irvine, candidate for the Republican nomination for U.S. Senate, met last week with the Register Editorial Board. As with his opponents – Carly Fiorina and Tom Campbell – we found much to like. Indeed, his positions on taxes, the proper limited role of small government, free enterprise and health care closely coincide with the freedom-cherishing positions the Register has held for years.

Given those ideological pluses, we found another of Mr. DeVore's traits most compelling: His consistency and potential for predictability. He remains faithful to the positions he has held since 2004 when first elected to the state Assembly. We believe it's likely he will remain true to those principles, despite shifting winds of circumstance and political faddism. In short, we find Mr. DeVore transparently reliable.

Oppose Statehood for Puerto Rico (HR 2499) Before It's News

HR 2499 would actually force a yes-or-no vote by Puerto Ricans on whether Puerto Rico should maintain the “current political status” of the island. This sounds innocent enough until the second part of the legislation comes into play; a second vote would have to be administered, this one giving Puerto Ricans no option but statehood or full independence if the majority expresses dissatisfaction with the current political status. Even if there is no dissatisfaction and the “current political status” is favored, every eight years henceforth from the passage of HR 2499 Puerto Rico is forced to conduct another plebiscite on the matter at their own expense.

There are several problems that must first be exposed and debated before such a move should be made. The first is that of creating a bilingual country with the addition of an almost completely Spanish-speaking state. Then there is the problem of reassigning some seats in the U.S. House of Representatives by handing at least six or seven over to Puerto Rico, depriving six or seven existing states of one representative each because of the congressionally-mandated 435 seat cap. This type of political maneuvering seems very partisan because the seats in the Senate and the House would likely be Democratic ones, and the electoral votes awarded Puerto Rico might outnumber those of 22 current states.

Arizona acted because the U.S. government has abdicated its constitutional duty to protect the states from invasion and refuses to enforce America's immigration laws.


"We in Arizona have been more than patient waiting for Washington to act," said Gov. Jan Brewer. "But decades of inaction and misguided policy have created an unacceptable situation."


We have a crisis in Arizona because we have a failed state in Washington. What is the response of Barack Obama, who took an oath to see to it that federal laws are faithfully executed?


He is siding with the law-breakers. He is pandering to the ethnic lobbies. He is not berating a Mexican regime that aids and abets this invasion of the country of which he is commander in chief. Instead, he attacks the government of Arizona for trying to fill a gaping hole in law enforcement left by his own dereliction of duty.

Opportunist politicians looking for people to exploit for power and money such as Rep Luis Gutierrez (D-IL), Phoenix Mayor Phil Gordon, Rep Raul Grijalva and others flocked to the rallies. Alfredo Gutierrez of La Frontera Times wrote an article entitled "Arizona Passes Apartheid Era Laws Against Immigrants"1 and spoke at the rallies. Even the Nation of Islam Phoenix chapter sent out Charles Muhmumad to represent them and pave the way for the coming of Al Sharpton so that those who make money and gain power from exploiting the black community aren't left out in the cold during the coming fleecing of the poor. What respectable race-baiter wouldn't want to ensure that they are in on the ground floor of gaining votes, donations or coming back later for "favors" from a community they are taking advantage of?

By: Peter EavisWall Street Journal, 3/3/2010-- Has anyone in Congress actually explained to taxpayers how much they could be on the hook for if the banking system were to crater again?

Compromises are being struck in the Senate that could soon clear the way for the passage of financial-system-overhaul legislation. That would seem a cause for celebration, given the need for reform and the many sensible proposals in draft legislation. However, the overhaul could be undermined by parts that aim to construct enormous government backstops for banks. Indeed, if Congress gets its way, the taxpayer may soon have to stand behind some of the riskiest parts of banks' balance sheets.

Before the credit crisis, government support to the banks looked sensibly limited. Through the Federal Deposit Insurance Corp., the taxpayer effectively guaranteed deposits up to a certain size. In theory, other bank liabilities, like bonds, interbank loans and derivatives claims, weren't backed. But when the credit crisis hit, the government rushed in to make sure all manner of bank liabilities could be repaid, including even "repo" obligations, short-term loans whose collateralized nature was supposed to make them super-safe.

Now, in the overhaul legislation, Congress effectively wants to formalize much of that emergency support. Creditors to banks could gain protection that lenders to other sectors will likely never enjoy, creating even more moral hazard. The two main proposed backstops are a program to guarantee bank debt and a $4 trillion Federal Reserve repo facility for banks to tap, both of which would be made available in shaky times.

Granted, these provisions contain features that aim to protect the government and the taxpayer. But this would be difficult in practice. The draft legislation would make it possible for the U.S. to lend to a large financial firm it had seized because it was unstable. The rationale for this is that some debts need to be honored to prevent financial contagion. But that standard could easily lead to the government once again paying out on the sort of derivatives obligations that nearly sank American International Group. As government defenders of the AIG bailout repeatedly say, those were done to prevent contagion.

What should Congress have done? First, instead of enshrining a system for backstopping liabilities like market debt, legislation should have put defined limits on it-- and forced firms that use a lot of it to hold more capital. Second, the advantageous treatment derivatives counterparties enjoy under bankruptcy law should have been reversed. These perks undermine market discipline and can increase systemic instability when a firm fails, says Harvard University law professor Mark Roe.

Congress is highly unlikely to insert such changes. In January, President Obama said he would send back an overhaul bill that doesn't contain "real reform." The backstops are reason alone to do just that.

An important detail that is neglected in news coverage is that all the multiple-victim public shootings in America - crimes in which more than three people were killed - happened where legal concealed handguns are banned. The Wytheville post office is such a gun-free zone, not to mention that the felon who committed the crime was banned from possessing a firearm anywhere. The Oklahoma City attack was stopped because the man who stopped it could carry a concealed handgun.

Though back room secret dealings are as old as the Wormley House Agreement ,when Hayes was given the Presidency over Tilden, the brazen imperial arrogance of the Democrat leadership has raised the bar for all future despots for generations to come.
